OVERVIEW

Welcome to Wandersnout.

Wandersnout is an online store operated by Zizush, registered with the Dutch Chamber of Commerce under number 94740763. In these terms, “we”, “us” and “our” refer to Zizush, trading as Wandersnout.

These terms and conditions describe the rights and obligations that apply when you visit our website, place an order or use our services.

By visiting our website or placing an order, you agree to these terms and conditions, our privacy policy, shipping policy and refund policy.

SECTION 1 - ACCESS AND ACCOUNT

You may use our website for personal, non-commercial purposes and only in a way that complies with the law.

When you place an order or create an account, you are responsible for providing accurate, complete and current information, such as your name, email address, billing address, shipping address and payment details.

You are responsible for keeping your account details secure. You may not transfer, sell or otherwise make your account available to third parties.

SECTION 2 - OUR PRODUCTS

We do our best to display and describe our products as clearly and accurately as possible. However, colours, dimensions or details may differ slightly from what appears on your screen, for example because of screen settings, lighting or production batches.

Our products are intended for normal use as described on the product page. Pet products should always be used with common sense and, where appropriate, under supervision. Check products regularly for wear or damage and stop using a product if it no longer appears safe.

We reserve the right to change product descriptions, prices, images, availability and our assortment at any time. This does not affect orders that we have already confirmed.

SECTION 3 - ORDERS

When you place an order, you make an offer to purchase the product. Your order is accepted by us when you receive an order confirmation from us.

We reserve the right to refuse or cancel an order, for example if a product is unavailable, there is an obvious error in pricing or product information, or there is suspected misuse or fraud.

Please check your order carefully before placing it. If you want to change or cancel an order, contact us as soon as possible. If the order has already been processed or shipped, we may no longer be able to make changes or cancel it.

Purchases can only be returned in accordance with our refund policy.

SECTION 4 - PRICES AND PAYMENT

Prices are displayed in the currency configured for your market. Applicable taxes and shipping costs are shown during checkout before you place the order.

Prices, offers and promotions may change. For an order that has already been placed, the price shown at checkout at the time of ordering applies.

Payments are processed through secure payment providers. Wandersnout/Zizush does not itself store full payment details.

You are responsible for providing accurate and complete payment, billing and contact information.

SECTION 5 - SHIPPING AND DELIVERY

We do our best to process orders carefully and deliver them within the indicated delivery time. Delivery times are estimates and may vary due to demand, carriers, customs processing or other circumstances outside our control.

The risk of loss or damage passes to you when the order is received by you or by a third party appointed by you.

If an order is delayed or does not arrive, please contact us. We will review the situation with you and work towards an appropriate solution.

SECTION 6 - RETURNS AND REFUNDS

You have the right to withdraw from your order within 14 days after receipt without giving a reason where this statutory right applies, unless a legal exception applies.

In addition, as a service, we may offer a longer return period as stated in our refund policy.

Products must be returned unused, clean and in their original condition, unless the product is defective or the wrong product was delivered.

For hygiene and safety reasons, used pet products cannot always be returned, unless the product is defective or was delivered incorrectly.

SECTION 7 - INTELLECTUAL PROPERTY

All content on our website, including text, images, logos, product presentations, designs, graphic elements and brand materials, is owned by Wandersnout/Zizush or used with permission from the rights holder.

You may not copy, distribute, modify, republish or commercially use this content without our prior written permission.

The Wandersnout name, logo and related brand materials may not be used without our permission.

SECTION 8 - THIRD-PARTY TOOLS AND SERVICES

Our online store uses third-party services such as Shopify, payment providers, shipping services, review tools, tracking tools and other technical or commercial service providers.

We are not responsible for third-party services over which we have no direct control. Use of external services may be subject to the terms and privacy policies of those third parties.

SECTION 9 - THIRD-PARTY LINKS

Our website may contain links to third-party websites or services. We are not responsible for the content, operation, security or accuracy of third-party websites.

If you visit an external website or make a purchase there, you do so at your own risk. Always review the terms and privacy policy of the relevant party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Our online store is hosted and supported by Shopify. Shopify provides the technical infrastructure that enables us to offer our online store.

All purchases made through our online store are made directly from Zizush, trading as Wandersnout. Shopify is not a party to the purchase agreement between you and us.

SECTION 11 - PRIVACY

When you use our website or place an order, we process personal data. How we handle personal data is described in our privacy policy.

By using our website, you acknowledge that you have had the opportunity to review our privacy policy.

Because our online store is provided through Shopify, certain personal data may also be processed by Shopify and other service providers to enable the online store, payments, shipping and other services.

SECTION 12 - REVIEWS, FEEDBACK AND USER CONTENT

If you share a review, comment, photo, suggestion or other form of feedback with us, you give us permission to use it to manage, improve and promote our online store and products, to the extent permitted by law.

You are responsible for the content you share. You may not submit false, misleading, offensive, unlawful or infringing content.

We reserve the right to moderate, refuse or remove reviews or other user content if it violates these terms or the law.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Information on our website may occasionally contain typographical errors, inaccuracies or omissions, for example in product descriptions, prices, offers, shipping costs, delivery times or availability.

We reserve the right to correct errors, inaccuracies or omissions and update information. If an error affects an order you have placed, we will contact you.

SECTION 14 - PROHIBITED USE

You may not use our website for unlawful, harmful, misleading or fraudulent purposes.

This includes, but is not limited to:

- infringing our rights or the rights of third parties;
- providing false or misleading information;
- distributing viruses, malware or harmful code;

We reserve the right to restrict or block access to our website or services where misuse occurs.

SECTION 15 - PRODUCT INFORMATION AND STATUTORY RIGHTS

We do our best to describe our products as clearly and accurately as possible. Minor differences in colour, dimensions or appearance may occur.

Nothing in these terms limits your statutory rights as a consumer. You are entitled to a product that meets what you may reasonably expect from it under applicable law.

If a product is defective, damaged or delivered incorrectly, contact us as soon as possible with your order number and clear photos. We will review the situation with you and work towards an appropriate solution.

SECTION 16 - LIABILITY

To the extent permitted by law, Wandersnout/Zizush is not liable for indirect loss, consequential loss, loss of profit, or damage caused by incorrect, careless or unusual use of products.

This limitation does not apply to damage resulting from intent, gross negligence or circumstances in which liability cannot legally be excluded.

Always use products in accordance with the information on the product page and regularly check pet products for wear or damage.

SECTION 17 - INDEMNIFICATION

You agree to indemnify us for damage, costs or claims arising because you breach these terms, violate the law or infringe the rights of third parties.

This indemnification applies to the extent permitted by law.

SECTION 18 - FORCE MAJEURE

We are not liable for delays or failures caused by circumstances outside our reasonable control, such as carrier disruptions, strikes, technical failures, government measures, customs delays, natural disasters, pandemics or other force majeure events.

SECTION 19 - TERMINATION

We may restrict or terminate your access to our website or services if you breach these terms or in cases of misuse, fraud or unlawful conduct.

Provisions that by their nature are intended to remain in effect after termination will continue to apply.

SECTION 20 - SEVERABILITY

If any provision of these terms is found to be invalid, void or unenforceable, the remaining provisions remain fully effective.

The invalid provision will then be replaced or interpreted in a way that reflects the purpose of the original provision as closely as possible while remaining valid and enforceable.

SECTION 21 - ENTIRE AGREEMENT

These terms and conditions, together with the policies referred to in them, form the entire agreement between you and us regarding the use of our online store and placing orders.

Failure to immediately enforce a right or provision does not mean that we waive that right.

SECTION 22 - GOVERNING LAW

These terms and conditions and agreements between you and Zizush, trading as Wandersnout, are governed by Dutch law, without limiting any mandatory consumer rights that apply to you under applicable law.

Disputes are preferably resolved by mutual agreement. If that is not possible, disputes may be submitted to a competent court as provided by applicable law.

SECTION 23 - CHANGES TO THE TERMS

We reserve the right to amend these terms and conditions. The most recent version is always available on our website.

Changes apply from the time they are published on our website unless stated otherwise. Orders already placed remain subject to the terms that applied at the time of ordering.
